Terms of Service

These terms govern the use of localplatedigital.com and the purchase of Local Plate Digital services.

1. Services

Local Plate Digital provides restaurant websites, delivery-menu organization, menu descriptions and modifiers, Google Business Profile optimization, connection of existing social profiles, profile guidance, and related consulting. New social-account creation and Yelp claiming are not included unless separately agreed in writing. The selected package, proposal, or signed agreement defines the exact scope.

2. Client Service Agreement

Larger projects may require a signed Client Service Agreement. If a signed agreement conflicts with these website terms, the signed agreement controls.

3. Client responsibilities

Clients must provide accurate information, authorized materials, necessary access, timely feedback, and final approval. Local Plate Digital is not responsible for errors contained in client-supplied or approved information.

4. Account access

The client authorizes Local Plate Digital to access approved business accounts solely to perform contracted services. Authorized-user access should be used instead of primary password sharing whenever possible.

5. Payments

Prices and schedules appear on the website, Stripe checkout, proposal, or agreement. Past-due balances may result in paused work, suspended support, delayed launch, or website deactivation.

6. Recurring services

Managed Website Care and Restaurant Digital Support are month-to-month unless stated otherwise. Clients authorize the recurring charge shown at checkout and may cancel before the next billing date.

7. Website hosting

The Restaurant Website + Menu Launch includes 30 days of care. Managed websites require an active care plan after that included period. If the plan ends, the website may be taken offline after the current paid period. Migration or rebuilding is not included unless agreed in writing.

8. Revisions and timelines

Packages include the revisions described in their scope. New pages, platforms, services, or a major change in direction may require another quote. Timelines are estimates and may be extended by client delays or third-party requirements.

9. Third-party platforms

Local Plate Digital does not control Stripe, Google, Yelp, delivery services, social platforms, domain registrars, or hosting providers and cannot guarantee approval, availability, rankings, processing times, or continued access to a feature.

10. Ownership

Clients retain their domains, trademarks, client-supplied materials, and business accounts. Local Plate Digital retains its templates, reusable code, components, systems, methods, and preexisting materials. Use rights begin after full payment and remain subject to any required hosted-service plan.

11. Portfolio use

Unless a client requests otherwise in writing, Local Plate Digital may display completed public-facing work in its portfolio, website, proposals, and social media without exposing confidential information.

12. No guarantee

Local Plate Digital performs services professionally and in good faith but does not guarantee a specific increase in orders, revenue, visitors, rankings, or third-party approvals.

13. Legal compliance

Clients are responsible for reviewing their menu information, pricing, claims, accessibility needs, and legal requirements. Local Plate Digital does not provide legal, accounting, or tax advice.

14. Limitation of liability

To the maximum extent permitted by law, Local Plate Digital is not responsible for indirect, incidental, special, or consequential losses. Total liability will not exceed the amount paid for the applicable service during the preceding six months.

15. Governing law

These terms are governed by California law. Unresolved disputes will be handled in a court with appropriate jurisdiction in Monterey County, California, unless otherwise agreed in writing.
